Terms of Service & Acceptable Use Policy

By accessing or using the services provided by Shika Cloud, you agree to be bound by these Terms of Service. If you do not agree to these terms, you must not use our services.
1. Acceptable Use Policy (AUP)
To protect our infrastructure and reputation with upstream providers, we enforce a zero-tolerance policy against abuse. Prohibited activities include, but are not limited to:
- Spam: Sending unauthenticated or unsolicited bulk email (port 25 is blocked by default).
- Mining: Engaging in cryptocurrency mining or any high-CPU usage activity that negatively impacts the host node.
- Malware: Hosting or distributing viruses, botnets, or phishing materials.
- Illegal Content: Hosting content that violates the laws of Kenya or the jurisdiction of the upstream datacenter.
VIOLATION OF THE AUP RESULTS IN IMMEDIATE SERVICE TERMINATION WITHOUT REFUND.
2. Refund & Billing Policy
All sales are final. Once a Virtual Machine, Domain, or Managed Server has been provisioned and made active, we do not offer refunds, prorated credits, or wallet withdrawals.
- Failed Provisioning: In the rare event that our infrastructure partners fail to deliver a server, your account will be automatically credited/refunded to your wallet.
- Cancellations: You may cancel your subscription at any time via the dashboard. Your service will remain active until the end of the current billing cycle, at which point all data will be permanently erased.
3. Scope of Support
Shika Cloud provides two distinct levels of service:
- Unmanaged VPS (IaaS): We are responsible for the physical availability of the server. We do NOT manage your operating system, security updates, or applications. You are the system administrator.
- Optional Server Administration Services: If we separately agree to provide administration support, that work covers operating system maintenance, security hardening, and monitoring only. Application code, business logic, and third-party software running on your server remain your responsibility unless separately agreed in writing.
4. Limitation of Liability
Shika Cloud acts as an orchestration and management layer for your cloud resources. We shall not be held liable for any loss of revenue, data loss, or indirect damages resulting from server downtime, infrastructure partner insolvency, or hardware failure.
5. Governing Law
These terms shall be governed by and construed in accordance with the laws of Kenya, without regard to its conflict of law provisions.
